Article 1: Content and services offered by TENDRESHISTOIRES.COM

tendreshistoires.com offers parents parenting consultations and a Dunstan Baby Language workshop.

Article 2: The Mission of Tendres Histoires

Accompanying parents in their own homes from the first days after giving birth to enable them to deal with these first moments in the best possible conditions, while providing them with advice following parenting consultations, sensory language consultations and a workshop on decoding baby cries (Dunstan Baby Language).

Article 3: Use of the site

3.1 Access to the tendreshistoires.com website

The site is accessible 24 hours a day, 7 days a week. Access to the site is free of charge. However, access to the site is free of charge, tendreshistoires.com does not guarantee that the site will function without interruption. Tendreshistoires.com reserves the right, without prior notice or compensation, to temporarily suspend access to the site, in particular to carry out updates or maintenance operations and to make modifications or improvements, without this list being exhaustive.

In the event of temporary or prolonged unavailability or even permanent closure of the site : tendreshistoires.com shall not be held liable for any damages other than those resulting directly from the non-performance of its obligations listed in these GCU.

Parents can use the site to request information via online forms.

3.2.1 Provisions specific to Users

The form is reserved for any natural person who has full legal capacity to enter into a commitment under these GCU, in the context of his or her own needs by following ART1 and ART2.

To this end, the user must provide all the information marked as compulsory. Failure to provide the information marked as compulsory will prevent the form from being sent. This information must be accurate

In particular, the user must provide a valid email address

In accordance with Article 8 of European Regulation 2016/679 of 27 April 2016 on the protection of personal data, known as the "RGPD", where the contract concerns a child under the age of sixteen (16), tendreshistoires.com makes every effort to ensure that the request is made by the person holding parental authority over the child concerned. By accepting these GCU, parents certify on their honour that they hold parental authority over the child(ren) for whom they wish to access the services.

If tendreshistoires.comUpon request, the parents/guardians must provide proof of parental authority over the child(ren) concerned, such as a birth certificate less than 3 months old (full copy or an extract of the birth certificate with filiation) showing the name of the person on the form; a copy of the court decision revoking or authorising the delegation of parental authority; or in the case of guardianship, a copy of the decision of the family council or a copy of the court decision appointing the guardian.

And finally.., tendreshistoires.com draws users' attention to the fact that by subscribing to the services, they will be charged the rates set out on the site for consultations and workshops.

3.2.2 Provisions laure Lemonnier

Laure Lemonnier is a natural person over 18 years of age, holding a diploma as a childcare assistant and baby crying instructor, with permission to work in France, civil liability insurance and a clean criminal record.

Article 4: Purchase of consultations - workshops - gift vouchers

All appointments, gift vouchers and packs purchased on the site must be paid for using PAYPAL or STRIPE by credit card.

All orders not paid in full will not be processed. 

Laure Lemonnier and tendreshistoires.com will not be held responsible for any problems occurring on the PAYPAL or STRIPE credit card sites.

No refund will be made after the purchase of a service or gift voucher. The only possibility will be to reschedule an appointment or to exchange a gift voucher.

No credit card will be recorded on the tendreshistoires website database. The tendreshistoires.com site uses the HTTPS secure protocol to protect data and transactions. The PAYPAL and STRIPE sites have their own protections specific to their operation and protection of personal data that tendreshistoires.com and Laure Lemonnier are not aware of. For any banking data stolen following a transaction on the site tendreshistoires via PAYPAL and STRIPE, Laure Lemonnier and Tendreshistoires would not be held responsible.

Article 5: Assessing the quality of assignments

Once an assignment has been carried out, the parent is invited to leave a comment on the quality of the assignment carried out on the laurenursebordeaux.fr testimonial page and give it a rating on our google business.

Article 6: Right of withdrawal

In accordance with article L. 221-18 of the French Consumer Code, the User accepting these GTUs has a right of withdrawal which may be exercised within fourteen (14) days of accepting these GTUs.

To do so, the User must send an e-mail message (to the following address contact@endreshistoires.com) clearly expressing the desire to exercise this right.

However, in accordance with article L. 221-28 1° of the French Consumer Code, the User expressly waives the right of withdrawal if he/she accesses and uses the Application or Platform before the end of the withdrawal period.

Article 7: Liability of Users

Generally speaking, the User undertakes to provide all other information and means necessary to enable the Mission to be carried out.

Users agree to pay the services ordered from Laure Lemonnier.

Article 8: Personal data collected

tendreshistoires.com collects, uses, stores and transmits certain personal data provided by Users in strict compliance with French data protection law, in particular the provisions of Act no. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties and those of the General Data Protection Regulation (RGPD).

tendreshistoires.com / Laure Lemonnier is the Data Controller and the Data Protection Officer is Sébastien ETCHAR, the Site Manager.

The site may contain links to other websites belonging to individuals, companies or organisations. tendreshistoires.com is in no way responsible for the content or privacy policy of these sites.

8.1 Nature of the Data

The Data collected by tendreshistoires.com are the data communicated by Users (on an optional or mandatory basis), in particular when sending a form (see Article 3).

Data by tendreshistoires.com during use of the site may in particular be information relating to personal life (lifestyle, family situation), identification data, technical data (version of Internet browser, version of operating system, IP address, identification information for the device from which the connection is made).

The purpose of collecting data is to provide Users with tendreshistoires.com a safe, optimal, efficient and personalised experience.

On the one hand, Data is collected for the purposes of using, managing, protecting, improving, detecting illegal or prohibited behaviour, resolving any technical problems and optimising the site.

The right to object

It allows Users to object to the processing of their personal data for legitimate reasons.

The right to act

It allows the User to lodge a complaint with the CNIL (https://www.cnil.fr/fr/plaintes) and to take legal action if the User considers that his/her rights have not been respected.

Article 9: Applicable law - Jurisdiction - Alternative dispute resolution methods

These GCU are governed by French law.

In the event of a disagreement between laurenursebordeaux.fr and a User, and where it has not been possible to resolve the disagreement by means of a written complaint to the customer service department (contact@laurenursebordeaux.fr), the User may have recourse free of charge to a consumer mediator with a view to resolving the dispute amicably (for further information, consult the site https://www.economie.gouv.fr/mediation-conso). The User may also refer the matter to the European Ombudsman.

Any disagreement or dispute that cannot be settled amicably shall be referred to the competent courts in accordance with the applicable rules of public policy.

Unless rules of public order assign jurisdiction to other courts, any disagreement or dispute that cannot be settled amicably shall be referred to the courts of Bordeaux.

Article 10: Miscellaneous

Should any provision of these GCU be rendered null and void by a change in legislation or a court ruling, this shall in no way affect the validity of and compliance with the other clauses of these GCU.
